APPLICATION will
be made to the
Durban High Court on
Friday for a
decision to remove
uMhlathuze City
Speaker, Cllr Elphas
Mbatha.
This after Mbatha,
the first
Respondent, refused
to put a Notice of
Motion calling for
his dismissal on the
Council agenda of 18
September.
The application,
along with 30
affidavits, was
submitted by Mayor
Denny Moffatt, with
Cllr Ivan Barnes and
Cllr Raphael Zikhali
as co-applicants.
They have asked that
the original Notice
of Motion now be
placed on the 7
November agenda.
The applicants have
further requested
that Mbatha recuse
himself, and not be
allowed to chair the
meeting.
Should this be
granted by the High
Court, Mbatha will
almost certainly be
voted out, given the
strength of the IFP/DA/Nadeco
alliance in the City
Council.
Voting will then
take place
immediately to elect
another speaker.
The applicants have
also requested the
High Court that
Mbatha should pay
the costs of the
application.
